Housing Expungement: Helping Clients Facing Homelessness, an MMLA Pro Bono Volunteer Training

Did you know that an eviction on someone's housing record only means that a case was filed against that person in housing court- not that the person failed to pay rent or violated a clause in their rental agreement? Did you know that even tenants who win their housing cases, or whose cases are dismissed often have evictions in their records? In Minnesota, it is the act of filing the case that creates the legal record of eviction, not the merits of the case.

For many renters in the state of Minnesota, having an eviction, also known as an unlawful detainer, in their housing history can mean the difference between being able to rent a good, safe, residence at a reasonable price, and becoming victim to a slumlord. Minnesotans with UD's on their record are forced into a second class type of rental- falling victim to double or triple damage deposits, higher rents, substandard properties in need of repair, or even becoming homeless due to their inability to rent an affordable property.

This training provides attorneys with the tools they need to understand how to analyze an eviction record and assist clients with the drafting and filing of expungement cases. Following the training, attorneys and legal advocates will be able to interview clients, prepare expungement motions, and represent clients in legal proceedings when practical.
