In the fall of 2013 the Minnesota Legislature enacted Minn. Stat. 582.043. This statute, which is part of the Minnesota foreclosure statutes, places certain requirements and restraints on qualifying mortgage servicers in regards to the foreclosure process. Such items include providing borrowers with loss mitigation options and the restriction on dual tracking during specific periods of the foreclosure procedure.
