Eviction Settlement Checklist

Use this checklist to guide you through an eviction settlement.  Remember that this settlement checklist is intended to cover the topics most likely to be at issue for your client, but may not cover every situation.

    If the tenant will move out of the property, complete this section.

    Date by which tenant will move out

    Whether landlord waives court costs

    When a writ may issue if tenant fails to vacate

    Whether landlord may obtain a writ earlier if tenant fails to make payments listed in settlement agreement by the agreed upon date

    Whether eviction action may be expunged if tenant vacates by the specified date and makes payment(s) to landlord in the amount and by the time specified in the agreement

    Complete this section if tenant will remain in possession of the property.

    State the amount of payment(s)

    State the date and time by which each payment must be made

    State to whom tenant will make the payment

    State method of payment (e.g. cash, money order, personal check)

    State method of payment delivery (e.g. mail, in person, direct deposit)

    State whether tenant must take specified actions to come into compliance with lease

    State date by which tenant must take actions to come into compliance with lease

    State whether landlord must take certain actions (repairs, clean up, removal of nuisance, etc.) before tenant’s payment is due

    State whether eviction action may be expunged upon specified conditions
