Discussion of the level of capacity required to execute a beneficiary designation, whether a Power of Attorney may be used to change a beneficiary designation (including 2016 Court of Appeals opinion on this issue), litigating beneficiary designation changes (whether in probate, state civil, or federal court), and when assets with beneficiary designations can be used to pay costs of administration and/or a spousal elective share.
