Due to globalization, societal mobility, and even telecommuting it is increasingly common for us to get a call from a parent who has a custody order issued by another state, or from a parent who wants a custody order but never even lived in the same state with the other parent, or any number of other possible situations in which another jurisdiction is involved. When this happens, you will need to be able to first answer one, all-important question: Should this even be heard here? To address this and other interstate custody issues, an attorney needs to have an understanding of the rules of the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) and the Parental Kidnapping Prevention Act (PKPA), including the exceptions to those rules, and the caveats to those exceptions. This CLE will provide a roadmap for answering that initial question and then how to effectively convince the Court that they do (or do not) have the authority to act.
