Swanson v. Brewster and the Collateral Source Law (teleconference option available)*

Learn about the importance of Swanson v. Brewster, including a brief analysis of the case, Minnesota collateral source law, and Swanson's potential effect on settlement, Medicare issues, and litigation strategy. For instance, the impact of Swanson on vulnerable adults is significant. Fewer damages are generally available to the elderly and disabled, making it difficult to provide meaningful resolution to injury and death claims when applying the case to this type of claim. In addition, the basis for the decision, namely the collateral source determination, may not readily apply in the cases of Medicare and Medical Assistance. The bottom line is that further clarification is needed, challenges are on the way, and the case has a chilling effect on vulnerable adult plaintiffs.
