This program will discuss third party custody and stand-by and temporary custodian matters:

• description of the statutory requirements;
• pro's and cons of each proceeding;
• considerations for the client to take into account before deciding how to proceed (both the parent making plans for the children, and the non-parent parties who want to care for the children after the parent has died;
• importance of taking into account the age of the children, their involvement with the non-custodial parent, their wishes with respect to where they will live if the custodial parent dies while they are still minors, etc.
