A discussion of the legal conflicts between the "BIG E"(one's moral values) and the "little e"(the Code of Professional Responsibility) in the capital context and ways that attorneys can resolve them.

This presentation will address unique ethical issues that occur in death penalty cases. Panelists will discuss several ethical dilemmas that capital defense attorneys face, including: representation of a client who volunteers to be executed; a lawyer's dilemma of when to tell the client or witnesses information that might encourage perjury directed to exoneration or mitigation of the sentence; the tension between the trial and the appellate attorney in capital cases; and the consequences of the American Law Institute's recent withdrawal of its model death penalty law. The faculty will also discuss the case of Alton Logan, an innocent man exonerated from death row after the actual murderer's attorneys waited 26 years until their client's death to reveal information that exonerated Mr. Logan. Finally, panelists will discuss the decisions by some lawyers to refuse to participate in death penalty cases for personal moral or ethical reasons. Question and answer session to follow.

Application will be made for two ethics credits.

Cost: $45. Reduced fee available for public interest attorneys and students.
