The Strategic Use of Litigation in Immigration Cases and in Cases Involving Immigrants

The panel will address the intersection of employment/civil rights law and immigration law and cutting-edge litigation tactics in cases involving immigrants; including:

discovery into immigration status of plaintiffs and material witnesses

pursuing claims under pseudonyms to minimize retaliation and other intimidation tactics; and
*

obtaining protective orders regarding predicate claims and subsequent litigation abuse.

The panel will also discuss mandamus and declaratory actions; immigration litigation trends, usefulness of class actions; and negotiation with AUSA.
